A jury trial is set to begin July 6 for an Arapahoe man charged with sexually assaulting his cousin.
The Fremont County Attorney's Office charged the 46-year-old with one count of first-degree sexual. If convicted, he would face five to 50 years in prison.
The adult was named in the records, but it is Ranger policy not to publish information that could tend to identify victims of incest.
The major evidence against the defendant noted in an affidavit in the case are an account from the alleged victim, results from a sexual-assault evaluation and a cracked tablet computer.
Identifying information about the alleged victim is redacted in court documents.
Investigators think the defendant was driving his cousin home on Aug. 3 when he took a detour, heading east on East Monroe Avenue until they passed all of the houses. The cousin reported he stopped twice to kiss her, and the second stop led to the assault.
The woman's aunt, who is the defendant's mother, raised the alleged victim, and she grew up referring to the defendant as her brother, though biologically he was her cousin, according to an affidavit in the case.
At the second stop, the man told the woman "This is going to happen here or at your house," investigators said.
The defendant exited his vehicle, took his clothes off and walked to the passenger side. There, he knocked the alleged victim's tablet computer out of her hands, tore her clothes off and raped her, according to investigators.
The defendant slipped during the assault, and the woman grabbed her clothes and her tablet and ran, investigators said. She hid behind some bushes until he stopped looking for her and drove away. The alleged victim flagged down a motorist who drove her to the Riverton Police Department.
There, an investigator saw the woman's tablet screen was broken, and she told him it cracked when the defendant knocked it out of her hand, the affidavit said. She also showed investigators where she said the assault happened, and underwent a sexual assault evaluation at SageWest Health Care at Riverton.
The affidavit does not discuss the results of the medical tests.
Jury selection for the trial is slated to begin on July 6 in Lander District Court at the Fremont County Courthouse.
